Vodafone Romania Fined RON7,000 For Conveyance Of Unsolicited Commercial SMS

In February, the authority conducted a checkup at Vodafone Romania following a complaint regarding potential breach of provisions of Law 677/2001, a press release of the authority read.

Article 12 of Law 506/2004 bans the conveyance of commercial text messages via automatic operating systems that do not require the intervention of a human operator via fax, e-mail or any other means using electronic communications services destined to the public, without the prior consent of the receiver.

"Therefore, the authority ascertained the breach of provisions as regards conveying unsolicited commercial text messages of Law 506/2004 and fined the mobile telephony operator RON7,000," the press release read.

In 2007, the authority also fined Vodafone Romania RON1,000 for illegal personal data processing, as well as RON5,000 for breaching article 13 of Law 506/2004 on personal data processing and privacy protection in the sector of electronic communications.

Vodafone Romania, the local unit of British Vodafone Group, is the country’s second largest mobile telephony operator with 9.65 million clients late 2008.
